Manufacturer’s Limited Warranty

This Warranty Policy (“Policy”) sets out the standard limited warranty offered by Global Futuretech Private Limited (“Company”, “we”, “us”, “our”), as the manufacturer of Electric Vehicle Supply Equipment (EVSE) sold under the brand name Power9, including AC and DC EV chargers, spare parts, and accessories (“Products”). This Policy forms part of, and should be read together with, our Terms & Conditions. Where a signed purchase agreement or warranty card states different terms for a specific transaction, that document shall prevail.

1. Warranty Coverage

1.1 The Company warrants that the Products shall be free from defects in materials and workmanship under normal use, installation, and service conditions, as per the Product’s datasheet and installation manual.

1.2  Standard warranty periods, unless otherwise stated in the order confirmation or warranty card:

      • AC chargers: [12/24] months from the date of [invoice/commissioning], whichever is earlier.

      • DC fast chargers: [12/24] months from the date of [invoice/commissioning], whichever is earlier.

      • Spare parts and accessories: [6/12] months from the date of invoice.

      • Repaired/replaced parts: balance of the original warranty period or [90] days from repair/replacement, whichever is longer.

1.3 The warranty is extended to the original purchaser and, where the Product is sold through the Company’s authorized channel partners for deployment at an end-customer site, to the first end-user at the originally commissioned site. The warranty is not otherwise transferable without the Company’s written consent.

1.4 Extended warranty and annual maintenance contracts (AMC/CMC) may be available for purchase; their terms are governed by the respective signed agreements.

2. What the Warranty Covers

During the warranty period, the Company shall, at its sole option and free of charge, repair or replace any part or Product found by the Company to be defective in materials or workmanship. Replaced parts or Products become the property of the Company. Where repair or replacement is not commercially practicable, the Company may, at its discretion, offer a refund of the depreciated value of the defective Product.

3. What the Warranty Does Not Cover

This warranty does not cover, and the Company shall have no liability for, defects, failures, or damage arising from:

   • installation, commissioning, energization, relocation, or repair by persons not authorized by the Company, or not in accordance with the installation manual;

   • input power supply conditions outside the specified range, including voltage fluctuations, phase failure, harmonics, or inadequate/improper earthing;

   • lightning, power surges, fire, flood, water ingress beyond the rated IP protection, earthquake, storm, or other acts of God or force majeure events;

   • physical damage, accident, negligence, misuse, abuse, vandalism, theft, or rodent/pest damage;

   • use of the Product outside its rated environmental or operating conditions, or with vehicles, cables, or connectors that are damaged or non-compliant with applicable standards;

   • unauthorized modifications, alterations, tampering with seals, or use of non-genuine parts or firmware;

   • normal wear and tear, cosmetic damage (scratches, dents, fading), and consumables (fuses, filters, indicator lamps, stickers/decals);

   • software, connectivity, or network issues attributable to third-party SIM/data services, cloud platforms, CMS/OCPP backends not provided by the Company, or the buyer’s IT environment;

  • failure to carry out recommended preventive maintenance, where such maintenance is specified;

  • Products whose serial number has been removed, defaced, or altered.

4. Warranty Claim Procedure

4.1 Warranty claims must be raised in writing to [support@power9.in] or through the support contact stated on the warranty card, quoting the Product model, serial number, invoice number, date of commissioning, site location, and a description of the fault (with photographs/videos where possible).

4.2 The Company may carry out remote diagnosis first. If unresolved, the Company will, at its discretion, depute a service engineer to the site or require the Product/part to be shipped to its designated service location.

4.3 For on-site service within the warranty period, the Company shall bear the cost of defective parts and labour for verified warranty defects. Travel, boarding, and lodging for site visits to locations beyond [30 km] from the Company’s nearest service point may be charged as per the Company’s prevailing service tariff, unless otherwise agreed.

4.4 Where the reported fault is found on inspection to be outside warranty coverage (Clause 3) or no fault is found, the Company’s inspection/visit charges and applicable repair costs shall be payable by the buyer.

4.5 The buyer shall provide safe access to the installation site, isolate the equipment where required, and make available site personnel as reasonably needed for diagnosis and repair.

5. Turnaround & Service Levels

The Company endeavors to respond to warranty claims within [48/72] business hours of registration and to resolve verified defects within a reasonable period, subject to fault diagnosis, spare availability, and site access. Specific service-level commitments, if any, are governed by separately signed AMC/SLA agreements.

6. Limitation of Liability

6.1 The remedies stated in this Policy are the buyer’s sole and exclusive remedies for defective Products. To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, or consequential loss, including loss of revenue, profits, business, charging downtime, energy sales, or data, arising from any Product defect or warranty service.

6.2 The Company’s aggregate liability in respect of any Product shall not exceed the invoice value of that Product.

6.3 Except as expressly stated in this Policy, all other warranties, conditions, and representations, express or implied, statutory or otherwise, including implied warranties of merchantability and fitness for a particular purpose, are excluded to the maximum extent permitted by law. Nothing in this Policy limits rights that cannot be excluded under applicable law, including under the Consumer Protection Act, 2019, where applicable.

7. Statutory Rights

This warranty is in addition to, and does not affect, any statutory rights available to consumers under applicable Indian law.

8. Governing Law

This Policy shall be governed by the laws of India, and disputes shall be subject to the dispute-resolution and jurisdiction provisions of the Company’s Terms & Conditions.
